Can I resubmit a payment application after a payment notice?

You can send further supporting information and ask for an assessment to be reviewed, but that does not automatically replace the application or reset notice deadlines.

The answer

You can send further supporting information and ask for the assessment to be reviewed. That is different from establishing a right to replace the application or change an already issued notice. Further evidence does not automatically reset the notice deadlines or the final date for payment.

Keep three questions separate: does the new evidence support a different valuation; can the current payment mechanism accommodate a correction or further payment; and what must be included in the next application if the difference remains unresolved? The answer is not automatically that the subcontractor must wait, nor that the payer must revalue before the current final date.

Example: a variation was left out because the instruction was missing

Assume a subcontractor applies for £80,000, including a £12,000 variation. A valid payer's payment notice identifies £68,000 and explains that the £12,000 has not been substantiated. The subcontractor then provides the instruction, measurement and valuation build-up.

The £12,000 is now a specific item for review. Its value and entitlement still need assessment against the actual subcontract and evidence. Ask the authorised person to confirm whether the current cycle can be adjusted, an additional payment can be agreed, or the item should be carried into the next application. Preserve the original £80,000 application, £68,000 notice, later evidence and any written agreement. Do not quietly replace the served files or count an additional payment twice next month.

If the payer accepts the extra £12,000, the parties should record the amount and payment arrangements clearly. If it remains disputed, prepare a reasoned valuation response and obtain legal advice where notice effect, entitlement or dispute procedure is contested. The absence of an attached written instruction alone is not a universal rule that a variation has no entitlement or value.

The situation

A subcontractor applies for £80,000, including a £12,000 variation. A valid Payment Notice identifies £68,000 because the instruction for the variation is missing. The instruction, the measurement and the valuation build-up then arrive after the notice.

What happens

  1. Both served documents, the application and the Payment Notice, are preserved as they stand.
  2. The instruction, the measurement and the valuation build-up are put forward with the question that follows.
  3. The subcontractor asks whether the current cycle can be adjusted, an additional payment agreed, or the item carried into the next application.

The outcome
