I have a notice to serve and the clock is running
I'm the payer this time, the deadline is days or hours away, and the notice has to be right first time.
What's happening?
The notice rules cut both ways. If you sit above a subcontractor in the chain, their application can become the Notified Sum, the figure you must then pay in full, unless your Payment Notice or Pay Less Notice goes out in time and in valid form. Miss it, and you pay the full applied sum this cycle regardless of what the work was worth, then spend the next cycle trying to claw it back.
Late notices usually fail on the details: the right sum, the reasons behind it, sent by the right person to the right person, in the way the contract requires, inside the deadline. A notice drafted in a hurry usually fails one of these quietly and gets found out in adjudication months later.
This is exactly the wrong moment to work it out from scratch, and you do not have to.
